Rep. McMillin’s HB 1034 regarding historic cemeteries passed out of the House Committee on Local Government 8 – 0. It expands the definition to include, not just those established before 1875 (and having pioneer leaders or American war veterans,) but also those in which a Civil War veteran is buried.
This, in effect, expands the cemeteries that come under IC 23-14-67. Under that chapter, if one of these cemeteries exists, lacks funds and is showing signs of neglect, the county commissioners can create a county cemetery commission which can, in turn, request a tax levy of up to $0.50 per $100 of assessed valuation in the county for the purpose of restoring and maintaining one of these historic cemeteries.
