HB 1026 passed the Senate Committee on Corrections, Criminal, and Civil Matters.
Among other things: It imposes certain obligations on cemetery owners to maintain a perpetual care fund. It penalizes the act of selling a vault that is not airtight and watertight without first advising the proposed buyer in writing of that fact. Embezzling funeral trust funds becomes a Class C felony.

All are good rules. Often people are in a daze when they make these decisions, and are at great risk of being taken advantage of. I can see where it would be simple to steal money from a living trust; especially if the kids didn’t know that mom or dad had one. Cemeteries are known to change ownership.
I have been fortunate in my vocation. The funeral directors I work with are quite ethical. However, I know there are some bad ones out there. Had one funeral home up here that closed down and they found human remains in the basement that were supposed to have been cremated.
