Sen. Greg Taylor has introduced SB 267 which has passed out of the Senate Committee on Corrections and Criminal Law. When the General Assembly modified the expungement law, it limited an employer’s ability to question an employee about the employee’s prior criminal history on an application such that the application could be phrased only in terms “that exclude expunged convictions or arrests, such as: ‘Have you ever been arrested for or convicted of a 7 crime that has not been expunged by a court?'” This new legislation would expand that limitation to interview questions as well.
The legislation also would impose a penalty on a violation by making it a Class C infraction and Class B infraction for multiple violations.
